GENERAL TERMS AND CONDITIONS OF SALE (GTC)
Effective from 21/10/2025
These general terms and conditions of sale (hereinafter the ” GTC “) govern the conditions applicable to any online sale of products marketed under the Maison Delarnak brand (hereinafter the ” Products “), made on the website www.maisondelarnak.com (hereinafter the ” Site “).
The online sale of Products on the Site is carried out, according to the terms and conditions of these General Terms and Conditions of Sale, by Maison Delarnak (hereinafter the ” Seller “).
The Terms and Conditions may be modified at any time in accordance with changes to the Site and/or regulations. The applicable Terms and Conditions are those in effect at the time the Buyer validates the order.

Appendix 1: Withdrawal form
1. SELLER IDENTITY – CONTACT – SCOPE

These General Terms and Conditions apply exclusively to sales concluded remotely via the Site between the Seller and consumer buyers.
2. PURCHASE CONDITIONS – CONSUMER CLIENT
2.1 The Site is intended for consumers (within the meaning of the Consumer Code), i.e. natural persons acting for non-professional purposes (hereinafter ” Buyer “).
2.2 The Buyer declares that he is of legal age and has the legal capacity to place an order.
2.3 The Seller reserves the right to refuse or cancel any order in the event of:
- abnormal demand or quantities clearly incompatible with a consumer purchase,
- suspicion of fraud
- payment incident
- incomplete or incorrect order information,
- Previous unresolved dispute.
3. PRODUCTS – AVAILABILITY – PRESENTATION
3.1 The essential characteristics of the Products are described on the Site (product sheet, composition, dimensions, colors, etc.).
3.2 The visuals are presented for illustrative purposes only: minor variations may exist (color depending on screen, material rendering, etc.) without affecting the essential characteristics.
3.3 Product offers are valid while stocks last. In the event of unavailability after ordering, the Buyer will be informed by email and refunded the sums paid for the unavailable Product(s).
4. PRICE
4.1 Prices are shown on the Site in the currency displayed at the time of purchase, inclusive of all taxes (TTC) unless otherwise indicated.
4.2 Any applicable delivery charges are indicated before final order confirmation.
4.3 The Seller reserves the right to change its prices at any time. The applicable price is the one displayed at the time of the order (payment confirmation).
5. ORDER
5.1 Order process:
- Product selection and addition to cart
- shopping cart verification (quantities, options, address),
- delivery options,
- payment options,
- validation and payment.
5.2 Creating a customer account is optional. The Buyer can order as a guest.
5.3 In accordance with Article L.221-14 of the Consumer Code, the order is validated when the Buyer clicks on the confirmation button (e.g., “Pay” / “Order”) implying an obligation to pay .
5.4 The contract is formed upon sending the Buyer a confirmation email (hereinafter ” Order Confirmation “). The Confirmation summarizes the essential elements: Products, price, delivery, order number.
6. PAYMENT
6.1 Payment is made online via the means offered at the time of checkout (bank card, local payment solutions, etc. depending on availability).
6.2 Payments are processed via secure providers. The Seller does not have access to the Buyer’s bank details.
6.3 In case of refusal of payment, the order is automatically cancelled.
7. SHIPPING – DELIVERY
7.1 Delivery areas: eligible countries are those offered at checkout.
7.2 Delivery Times: Estimated delivery times are indicated at the time of ordering. In accordance with the Consumer Code, delivery will take place no later than 30 days from the Order Confirmation, unless otherwise specified and accepted by the Buyer.
7.3 Terms: Delivery is made to the address provided by the Buyer. The Buyer must provide accurate and complete information.
7.4 Transfer of risk: in accordance with Article L.216-4 of the Consumer Code, the risk is transferred to the Buyer when he/she takes physical possession of the package (or when a designated third party receives it).
8. RECEIPT – RESERVATIONS – DELIVERY PROBLEMS
8.1 Upon receipt, the Buyer must check the condition of the package and the Products.
8.2 In the event of a visibly damaged package, the Buyer must:
- to express reservations to the carrier (if possible),
- and contact customer service within 48 hours by email at contact@maisondelarnak.com, with photos (package + label + damage).
8.3 In case of missing Product, incorrect reference or defective Product upon receipt: contact customer service as soon as the problem is noticed.
9. RIGHT OF WITHDRAWAL
9.1 In accordance with Article L.221-18 of the Consumer Code, the Buyer has a period of 14 days from receipt of the Product to exercise his right of withdrawal without having to justify his decision .
If the order relates to several Products delivered separately, the period runs from the receipt of the last Product.
9.2 To exercise the right of withdrawal, the Buyer must notify their decision before the expiry of the 14-day period, by:
- email to contact@maisondelarnak.com, or
- use of the withdrawal form (Appendix 1).
9.3 Legal exceptions: the right of withdrawal does not apply, in particular, to Products personalized or made according to the Buyer’s specifications (L.221-28 of the Consumer Code).
10. RETURNS – CONDITIONS – PROCEDURE
10.1 The Buyer must return the Product(s) within 14 days of the notification of withdrawal.
10.2 Return conditions: Products must be returned:
- unworn (except for reasonable fitting), unwashed, undamaged,
- with labels and any accessories,
- in their original packaging or equivalent protective packaging.
10.3 Return shipping costs: Unless otherwise stated on the Website (special offer, country, etc.), return shipping costs are the responsibility of the Buyer in the event of a cancellation.
In the event of an error attributable to the Seller (incorrect product/proven defect), the Seller will cover the return shipping costs according to the terms communicated by email.
10.4 The Buyer is responsible for the package until it is received by the Seller. It is recommended to use a tracked shipping method.
10.5 Return address: provided by customer service when the return procedure is opened (in order to guarantee proper receipt and tracking).
11. REFUNDS
11.1 In the event of a valid cancellation, the Seller will reimburse:
- the price of the returned products,
- as well as the initial standard delivery charges (if the Buyer had chosen a more expensive delivery than the standard one, the extra cost is not refunded),
in accordance with Article L.221-24 of the Consumer Code.
11.2 If the order is partially returned, the initial delivery charges may not be refunded (depending on the pricing/delivery structure displayed at the time of the order). In all cases, the applicable rule is that indicated at checkout and complies with consumer law.
11.3 Time limits: the refund will be issued no later than 14 days from the date of receipt of the Products or proof of shipment provided by the Buyer (the Seller may defer until actual receipt).
11.4 Method of refund: refund via the same payment method used when ordering, unless technically impossible.
12. LEGAL GUARANTEES
Regardless of the right of withdrawal, the Buyer benefits from legal guarantees.
12.1 Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code):
The Buyer has a period of 2 years from the delivery of the goods to take action.
They may obtain repair or replacement of the Product, subject to legal conditions.
12.2 Warranty against hidden defects (articles 1641 et seq. of the Civil Code):
The Buyer may take action in the event of a hidden defect rendering the Product unfit for use or significantly diminishing its use.
12.3 For any request: contact contact@maisondelarnak.com with photos and a description of the problem. The Seller will indicate the procedure (return, assessment, exchange, repair, refund as appropriate).
13. PERSONAL DATA
Personal data is processed in accordance with the Site’s Privacy Policy . The Buyer is encouraged to review it.
14. FORCE MAJEURE
A force majeure event as defined in Article 1218 of the Civil Code suspends the affected obligations for the duration of the event.
15. LIABILITY – LIMITATIONS
15.1 The Seller shall not be held liable for damages resulting from misuse, improper use or lack of maintenance.
15.2 The Seller’s liability is limited to direct and foreseeable damages, within the limits permitted by law.
15.3 The information and visuals on the Site are provided with the greatest possible accuracy, but slight non-substantial errors may exist without incurring any liability on the part of the Seller.
16. INTELLECTUAL PROPERTY
All elements of the Site (texts, visuals, logos, design, content) are protected and remain the property of the Seller or its partners. Any unauthorized reproduction/use is prohibited.
17. APPLICABLE LAW – DISPUTES – MEDIATION
17.1 These General Terms and Conditions are governed by French law .
17.2 Prior claim: in case of dispute, the Buyer must first contact the Seller by email: contact@maisondelarnak.com in order to seek an amicable solution.
17.3 Consumer Mediation: In accordance with the Consumer Code, the Buyer may have recourse, free of charge, to a consumer mediator once the mediator has been appointed by the Seller .

17.4 European ODR (Online Dispute Resolution) Platform: The European Commission provides a dedicated platform.
17.5 In the absence of an amicable agreement, the competent courts will be determined in accordance with the rules of common law.
18. MISCELLANEOUS PROVISIONS
18.1 If one clause is declared void, the others remain applicable.
18.2 Failure to invoke a clause at a given time does not constitute a waiver.
